My Sale Price Pty Ltd (My Sale Price, we, us or our) respects your privacy. This policy explains how we collect, hold, use and disclose personal information through our Australian website mysaleprice.com.au, our property-appraisal referral service, our agent membership program and our related business activities.
In plain language: when a homeowner asks us to arrange a property appraisal, we may provide the enquiry and contact details to one or more suitable participating member agents so they can respond to your request, My Sale Price does not complete or directly provide the property appraisal.
1. About this policy
We handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs) where they apply to us. We also aim to follow those principles as a matter of good privacy practice. This policy should be read with and in conjunction with any shorter collection notice shown on a form or at the point personal information is collected by us.
Personal information means information or an opinion about an identified individual, or an individual who is reasonably identifiable, whether or not the information is true or recorded in a material form.
2. The personal information we collect
The information we collect depends on how you interact with us. It may include:
• identity and contact details, such as your name, email address, telephone number and postal address;
• homeowner enquiry information, such as the property address, appraisal type, preferred contact method and information included in comments or correspondence;
• agent and membership information, such as agency details, professional role, licence or registration details, service areas, profile photograph, biography, membership tier and application material;
• account, billing and transaction records relating to memberships or other paid services;
• communications, support requests, complaints, survey responses and records of dealings with us; and
• technical and usage information, such as IP address, browser and device information, pages visited, referring website, cookie identifiers and website interaction data.
We do not ordinarily need sensitive information or data that would reasonably be viewed as private. Please do not include health information, government identifiers or other sensitive information in form text fields unless it is genuinely necessary. If we need sensitive information, we will seek consent or rely on another lawful basis.
3. How we collect personal information
We may collect personal information:
• directly from you through online forms, membership applications, telephone calls, emails, correspondence and other interactions;
• from an authorised representative, referrer, member agent, agency, business partner or publicly available professional source where appropriate;
• automatically when you use our website, through cookies, logs and similar technologies; and
• from service providers that support payments, communications, website operation, analytics, fraud prevention, customer support, local or federal government agencies.
If we receive unsolicited personal information, we will assess whether we could lawfully have collected it. If not, and if we are not required to retain it, we will take reasonable steps to destroy or de-identify it.
4. Why we collect, use and disclose personal information
We may collect, hold, use and disclose personal information to:
• receive and manage homeowner appraisal enquiries and connect homeowners with participating member agents;
• assess agent membership applications, establish and administer memberships, maintain agent directory profiles and provide member support;
• communicate about enquiries, applications, accounts, payments, service updates and complaints;
• operate, secure, maintain and improve our website, services, business processes and user experience;
• prevent misuse, investigate suspected fraud or security incidents and protect our legal rights and the rights of others;
• meet taxation, accounting, corporate, regulatory, law-enforcement and other legal obligations; and
• send marketing or promotional communications where you have consented or where otherwise permitted by law.
If you do not provide information required for an appraisal enquiry or membership application, we may be unable to arrange the requested referral, assess the application or provide the relevant service.
5. Homeowner appraisal enquiries and referrals
My Sale Price is an introduction and directory platform. We do not provide the property appraisal or later real estate services. When you submit an appraisal enquiry, you request that we use the information to identify and refer the enquiry to one or more participating member agents who may service the property’s location.
We may disclose your name, contact details, property address, appraisal type and relevant enquiry information to the selected agent or agents. Selection may take account of location, service area, availability, membership status and other operational criteria. A referred agent is an independent business or professional and handles the information it receives under its own legal obligations and privacy policy practices.
We do not sell personal information as a standalone data product. The disclosure of appraisal-enquiry information to member agents forms part of the referral service requested by the homeowner. Advertisers do not receive your personal information merely because they advertise with us, unless you separately request contact or consent to the disclosure, or join our newsletter subscription.
6. Member agents and directory profiles
Information that a member agent supplies for a directory profile may be published on our website and may be indexed by search engines. This can include the agent’s name, photograph, agency, professional details, service areas, biography, contact channels and membership category. Agents should only provide information they are authorised to publish and may ask us to update or remove public profile information, subject to membership and legal requirements.
Membership applications and supporting material are used to assess eligibility, administer the relationship, provide benefits, manage payments and maintain service quality. We may verify professional information with agencies, licensing or registration sources where reasonably necessary.
7. Who we may disclose personal information to
Depending on the circumstances, we may disclose personal information to:
• participating member agents and their agencies for homeowner appraisal referrals;
• website hosting, cloud storage, email, communications, customer-management, analytics, security, technical-support and payment service providers;
• professional advisers, insurers, auditors, accountants and legal representatives;
• government agencies, regulators, courts, law-enforcement bodies or other parties where required or authorised by law;
• a potential purchaser, investor or adviser in connection with a proposed business transaction, subject to appropriate confidentiality safeguards; and
• other parties with your consent or at your direction.
Where a third-party payment processor is used, payment details may be collected and handled directly by that provider. We generally receive transaction and account information rather than complete card details.
8. Website cookies and analytics
Our website may use cookies, pixels, logs and similar technologies to operate essential functions, remember preferences, understand site use, measure campaign performance and improve services. Some technologies may be provided by third parties and may associate website activity with information those parties already hold.
You can control many cookies through your browser or any cookie controls made available on the website. Blocking essential cookies may affect website functionality. Where consent is required for non-essential cookies, we will seek it through the relevant website controls and alerts.
9. Direct marketing
We may send information about My Sale Price services, membership opportunities or relevant updates where you have consented or where permitted by law. Marketing communications will identify the sender and provide a practical way to unsubscribe. You can opt out at any time by using the unsubscribe facility or contacting us. We will action electronic-marketing unsubscribe requests within five working days.
Opting out of marketing will not prevent us from sending necessary service communications about an active enquiry, application, membership, payment, security matter or legal obligation.
10. Overseas processing and disclosures
Some technology and professional service providers may store, access or process personal information outside Australia, including in the United States and New Zealand, other countries in which those providers operate. The countries involved may change when providers or their infrastructure changes.
Where the APPs apply to an overseas disclosure, we will take reasonable steps required by law to address the recipient’s handling of the information. Where practicable, current information about likely overseas locations will be included in this policy, a collection notice or provided upon request.
11. Security, retention and data breaches
We take reasonable technical and organisational steps to protect personal information from misuse, interference, loss and unauthorised access, modification or disclosure. These steps may include access controls, account security, secure service providers, backups, staff procedures and monitoring appropriate to the nature of the information. No internet or storage system can be guaranteed to be completely secure; however, we hold agents and subscriber’s details securely offline to prevent unauthorised online access.
We retain personal information for as long as reasonably needed for the purpose for which it was collected, to manage our relationship with you, resolve disputes and meet legal, accounting and recordkeeping obligations. When information is no longer required, we take reasonable steps to destroy or de-identify it, subject to lawful retention requirements and backup cycles.
If a data breach occurs, we will contain and assess it and take appropriate remedial action. Where the Notifiable Data Breaches scheme applies and an eligible data breach is likely to result in serious harm, we will notify affected individuals and the Office of the Australian Information Commissioner (OAIC) as required.
12. Accessing and correcting your personal information
You may ask for access to personal information we hold about you or ask us to correct information that is inaccurate, out of date, incomplete, irrelevant or misleading. Contact the Privacy Officer using the details below. We may need to verify your identity before responding.
We will respond within a reasonable period, generally within 30 days where practicable. We do not charge for making a request. If the law permits a reasonable charge for providing access, we will explain it in advance. If we cannot provide access or make a requested correction, we will explain the reason where required and advise available complaint options.
13. Privacy enquiries and complaints
If you have a privacy question or believe we have mishandled your personal information, please contact our Privacy Officer at privacy@mysaleprice.com.au. Describe the issue and include enough information for us to investigate. We will acknowledge a complaint promptly, generally within five business days, and aim to provide an outcome within 30 days, although complex matters may take longer.
If you are not satisfied with our response, you may contact the Office of the Australian Information Commissioner through www.oaic.gov.au. The OAIC may expect you to raise the matter with us first.
