1. About these Terms

1.1  These Website Terms and Conditions (Terms) govern access to and use of mysaleprice.com.au, including its pages, forms, agent directory, information and related online services (Website).

1.2  The Website is operated by My Sale Price Pty Ltd, ABN 88 152 441 766, trading as My Sale Price (My Sale Price, we, us or our).

1.3  By accessing or using the Website, or by selecting an acceptance box where one is provided, you agree to these Terms. If you do not agree, you should not use the Website or submit an appraisal request.

1.4  Paying member agents are also subject to separate Agent Membership Terms. If those terms conflict with these Terms in relation to an agent’s membership, the Agent Membership Terms apply to that extent, except when in conflict with any legislative or regulatory requirement.

2. About My Sale Price

2.1  My Sale Price operates an online introduction and directory platform. It enables homeowners and other authorised users to request a free, no-obligation sale or rental property appraisal from an independent member real estate agent.

2.2  In operating the Website and referral service, My Sale Price does not itself provide property appraisals, formal valuations, legal advice, financial advice, lending advice or conveyancing services.

2.3  My Sale Price is not a party to any agency agreement, listing agreement, management agreement or other contract that you may later enter into with a member agent or another service provider, or advertiser from time to time.

3. Property Appraisal Requests

3.1  You may use the Website to request a sale appraisal, rental appraisal or other property, related contact described on the relevant form.

3.2  My Sale Price does not charge homeowners for submitting an appraisal request through the Website. A member agent may later offer other services under a separate agreement, and you should consider the terms and fees of that agreement before accepting those services.

3.3  When you submit a request, My Sale Price may refer the information you provide to either (one) (two) or in some cases (three) member agents, having regard to factors such as property location, agent service area, availability and agent membership status.

3.4  By submitting the request, you consent to My Sale Price collecting the information in the form and disclosing the information reasonably necessary to the member agent or agents described at the point of submission so they can respond to your request.

3.5  You also consent to contact by the relevant member agent by telephone, email or SMS for the purpose of responding to the appraisal request. Consent to unrelated promotional marketing should be requested separately and is not a condition of submitting an appraisal request.

3.6  Submitting a request does not require you to appoint an agent, list a property, proceed with a sale or rental, or purchase any other service.

3.7  We do not guarantee that an agent will accept or respond to every request, or that a suitable agent will be available in every location at the time of request.

4. Independent Member Agents

4.1  Member agents operate independent businesses. They are not employees, representatives, partners or joint venturers of My Sale Price merely because they are listed on the Website or receive an appraisal request.

4.2  Each member agent is responsible for maintaining any licences, registrations, professional obligations and insurance required for their activities, and for the accuracy of information and advice they may provide.

4.3  A directory listing, membership badge or Founding Member recognition indicates participation in the My Sale Price network. It does not constitute a guarantee of an agent’s services, appraisal, conduct or results.

4.4  You remain responsible for deciding whether an agent is suitable for your needs and should independently verify their identity, current licence, experience, fees, service terms and any other matter important to your decision.

4.5  Any concerns about an agent’s services should first be raised directly with that agent. You may also notify My Sale Price if the concern relates to use of our Website, referral process or membership standards.

5. Appraisals Are Estimates, Not Formal Valuations

5.1  A property appraisal is generally an agent’s opinion or estimate based on information available at a particular time. It may differ from a formal valuation and may change with market conditions, property condition, comparable sales, rental demand and other factors.

5.2  Neither My Sale Price nor a member agent guarantees that a property will sell, rent, be financed or be valued by another person at the appraised amount.

5.3  You should obtain independent professional advice or a formal valuation where required for lending, taxation, family law, deceased estate, insurance, litigation or another formal purpose.

6. Your Responsibilities

6.1  You must be at least 18 years old and legally capable of using the Website and submitting a request.

6.2  You must provide information that is accurate, current and not misleading, and promptly correct any material error you become aware of.

6.3  You must be the property owner, or have the owner’s authority, to submit a request containing information about a property or another person’s contact details.

6.4  You must use the My Sale Price Website lawfully and must not submit fraudulent requests, impersonate another person, interfere with security or operation, introduce malicious code, scrape or harvest data without permission, or use information from the Website to send unsolicited communications.

7. Agent Directory and Website Information

7.1  Some directory and profile information is supplied by member agents. Although we may conduct reasonable independent checks or request corrections, information may change and we do not guarantee that every profile is complete or current at all times, member agents are responsible for advising My Sale Price of alterations or amendments to their status or agent profiles.

7.2  Website content is general information only. It should not be treated as a substitute for advice tailored to your property, finances, legal position or objectives.

7.3  Any description such as local, member, professional, Founding Member, Entry, Professional or Premier describes a network or membership category and must not be interpreted as a guarantee of a particular outcome or professional expertise.

8. Privacy and Communications

8.1  We handle personal information in accordance with our Privacy Policy, available at https://www.mysaleprice.com.au /privacy and the collection notice presented when information is requested.

8.2  We may send communications reasonably necessary to administer an appraisal request, respond to an enquiry, maintain security or provide important service information.

8.3  We will only send promotional electronic marketing where we have the consent or other lawful basis required. Marketing messages will identify the sender and provide a method of unsubscribing where required by law.

8.4  You are responsible for keeping your contact information current and for telling us if you believe information has been used or disclosed incorrectly.

9. Intellectual Property

9.1  Unless otherwise stated, the MySalePrice.com.au website and its text, graphics, logos, badges, layout, software and other content are owned by or licensed to My Sale Price and are protected by intellectual property laws as applicable to the registered IP trademark.

9.2  We grant you a limited, revocable, non-exclusive right to access and use the My Sale Price Website for personal and lawful purposes. You must not copy, reproduce, adapt, publish, sell, commercially exploit or create derivative works from our website content without permission, except where the applicable law permits.

9.3  Member badges and recognition materials may only be used by authorised members and in accordance with any brand or membership conditions supplied by My Sale Price from time to time.

10. Third-Party Websites and Services

10.1  The Website may link to third-party websites or services. Those services are operated independently and may have their own terms and privacy policy practices.

10.2  A link does not necessarily indicate endorsement. Except to the extent required by applicable law, My Sale Price is not responsible for third-party content, availability, security, services or privacy policies.

11. Website Availability and Changes

11.1  We aim to keep the Website available and accurate but do not guarantee uninterrupted, error-free or continuously secure operation. Maintenance, technical faults, cyber incidents or circumstances beyond our reasonable control may affect access.

11.2  We may change, improve, suspend or discontinue Website functions where reasonably necessary. Where practicable, we will avoid materially affecting an appraisal request already being processed without notice.

12. Australian Consumer Law

12.1  Nothing in these Terms excludes, restricts or modifies a consumer guarantee, right, remedy or liability that cannot lawfully be excluded, restricted or modified, including under the Australian Consumer Law.

12.2  Any disclaimer or limitation in these Terms applies only to the maximum extent permitted by law and must be read subject and in conjunction to your non-excludable rights.

13. Responsibility and Liability

13.1  To the extent permitted by law, My Sale Price is not responsible for the acts, omissions, advice, appraisals, statements, fees or services of an independent member agent, except to the extent that a loss was caused or contributed to by our own breach, negligence or unlawful conduct.

13.2  We are not responsible for loss caused by inaccurate information supplied by a user or third party, a decision made under a separate agreement with a member agent, unauthorised use contrary to these Terms, or an event outside our reasonable control, except to the extent the law requires otherwise.

13.3  Where the law permits a remedy for failure to comply with a guarantee to be limited, our liability may be limited, at our option, to supplying the relevant service again or paying the reasonable cost of having it supplied again. This clause does not apply where such a limitation would be unlawful or unfair.

13.4  You are responsible for reasonably foreseeable loss caused by your fraudulent, unlawful or deliberately harmful use of the My Sale Price Website, but not to the extent that My Sale Price or another person contributed to that loss.

14. Restricting or Ending Access

14.1  We may restrict or end access to the Website where we reasonably believe it is necessary to address a serious or repeated breach of these Terms, fraud, security risk, unlawful conduct, misuse of personal information or a legal requirement.

14.2  Where reasonable in the circumstances, we will provide notice and an opportunity to address the issue before restricting access. Immediate action may be taken where delay could cause inevitable or impending harm, compromise security or breach of the law.

15. Complaints and Dispute Resolution

15.1  You can submit a Website or referral-service complaint using the contact details in clause 19. Please describe the issue and provide the information reasonably needed to investigate it.

15.2  We will acknowledge and assess complaints within 48 hours and will try to resolve them fairly and within a reasonable time, having regard to their complexity.

15.3  Nothing in this clause prevents either party from seeking assistance from a regulator, tribunal or court where entitled to do so.

16. Changes to these Terms

16.1  We may amend these Terms to reflect changes to the Website, our services, business practices or applicable law, regulatory or legislative requirements. The current version and effective date will be published on the Website.

16.2  Where a change materially affects an existing user or request, we will take reasonable steps to provide notice before the change applies, unless an earlier change is required for legal or urgent security reasons.

17. General

17.1  If any provision of these Terms is held to be invalid or unenforceable, it will be read down to the extent necessary or severed, and the remaining provisions will continue to apply.

17.2  A failure or delay in enforcing a provision does not waive the right to enforce it at a later time.

17.3  These Terms are governed by the laws of Queensland, Australia. The parties submit to the courts and tribunals having jurisdiction in Queensland, subject to any right you have to bring a claim elsewhere under applicable law.

18. Definitions

18.1  Agent means an independent real estate agent or agency participating in the My Sale Price member network.

18.2  Appraisal means an estimate or opinion about a property’s potential sale price or rental value and is not necessarily a formal valuation.

18.3  Personal information has the meaning given by applicable Australian privacy law.

18.4  User, “you” or “your” means a person who accesses the Website or submits information through it.
