Terms for visitors, homeowners, directory users and appraisal referral users

This document reflects the combined My Sale Price Agent Directory and Agent Appraisal Referral Service.

These Terms explain the two ways homeowners can use My Sale Price: by choosing an agent through the Agent Directory or by asking My Sale Price to refer an appraisal request to a suitable member agent.

These Terms cover website visitors and homeowners. Paying member agents are also subject to these terms & conditions and may also be required to adhere to a separate Agent Membership Terms if applicable or required under the particular state or territory of Australia..

 1 About these Terms

1.1  These Website Terms and Conditions (Terms) govern access to and use of https://www.mysaleprice.com.au, including its pages, forms, Agent Directory, Agent Appraisal Referral Service, information and related online services (Website).

1.2  The Website is operated by My Sale Price Pty Ltd, ABN 88 152 441 766, trading as My Sale Price (My Sale Price, we, us or our).

1.3  By accessing or using the Website, or selecting an acceptance box where one is provided, you agree to these Terms. If you do not agree, do not use the Website or submit information through it.

1.4  Paying member agents are also subject to separate Agent Membership Terms. If those terms conflict with these Terms in relation to an agent’s membership, the Agent Membership Terms apply to that extent.

2 My Sale Price services

2.1  My Sale Price provides two related online services for homeowners:

• Agent Directory – homeowners may search or browse member agent profiles, choose an agent and contact that agent directly.
• Agent Appraisal Referral Service – homeowners may submit an appraisal request for My Sale Price to review and refer to one suitable licence-verified member real estate agent.

2.2  My Sale Price provides the Website, directory and referral process. It does not itself act as a real estate agent or provide property appraisals, formal valuations, legal advice, financial advice, lending advice, conveyancing or property management services.

2.3  My Sale Price is not a party to any agency agreement, listing agreement, management agreement or other contract that a homeowner may later enter into with a member agent or another service provider.

3 Agent Directory

3.1  The Agent Directory allows you to browse profiles and choose which member agent, if any, you wish to contact. My Sale Price does not choose an agent for you when you use this pathway.

3.2  Some profile information is supplied by member agents. We may review applications, conduct licence checks before approving profiles and request corrections, but professional status, availability and profile information can change.

3.3  A licence-verification statement, directory position, membership badge or profile feature is not a guarantee, recommendation or warranty of an agent’s suitability, conduct, service quality, appraisal or results.

3.4  Directory visibility or ordering may reflect factors such as location, search criteria, membership tier, paid profile features and Website rules. It should not be understood as an independent ranking of all agents available in the market.

3.5  If you contact an agent directly using contact details or an external link on a profile, your dealings with that agent are independent of My Sale Price. If you use a Website contact form, we may collect and transmit the enquiry as explained in our Privacy Policy and the notice shown with the form.

4 Agent Appraisal Referral Service

4.1  You may request a sales appraisal, property management appraisal or other property-related contact described on the relevant form.

4.2  My Sale Price does not charge homeowners for submitting an appraisal request. Member agents may pay subscription membership fees to My Sale Price. My Sale Price does not charge a separate referral fee or receive a share of an agent’s commission or transaction value.

4.3  My Sale Price reviews the request and may contact you to clarify relevant details. We then refer the information reasonably required to respond to the request to one suitable participating member agent.

4.4  Agent selection may take account of the property’s location, the service requested, agent service areas, availability, licence-verification status, membership eligibility and reasonable operational considerations. The referral is not a comparison of every agent in the market and is not a guarantee that the selected agent is the best agent for every homeowner.

4.5  By submitting the request, you consent to My Sale Price collecting the information in the form and disclosing the relevant information to the selected member agent so that the agent can respond.

4.6  You also consent to contact by the selected member agent by telephone, email or SMS for the purpose of responding to the appraisal request. Consent to unrelated promotional marketing should be requested separately and is not a condition of submitting a request.

4.7  Submitting a request does not require you to appoint the referred agent, list or manage a property, proceed with a sale or rental, or purchase another service.

4.8  We do not guarantee that an agent will accept or respond to every request or that a suitable member agent will be available in every location or for every requested service.

5 Independent member agents

5.1  Member agents operate independent businesses. They are not employees, representatives, partners or joint venturers of My Sale Price merely because they are listed on the Website or receive an appraisal referral.

5.2  Each member agent is responsible for maintaining any licences, registrations, professional obligations and insurance required for their activities, and for the accuracy of information, appraisals and advice they provide.

5.3  You remain responsible for deciding whether an agent is suitable for your needs. Before appointing an agent, you should independently check matters important to you, including identity, current licence, experience, fees, insurance and service terms.

5.4  Any concern about an agent’s appraisal or later services should first be raised directly with that agent. You may also notify My Sale Price if the concern relates to our Website, referral process, profile information or membership standards.

6 Appraisals are estimates

6.1  A property appraisal is generally an agent’s opinion or estimate based on information available at a particular time. It may differ from a formal valuation and may change with market conditions, property condition, comparable transactions, rental demand and other factors.

6.2  Neither My Sale Price nor a member agent guarantees that a property will sell, rent, obtain finance or be valued by another person at the appraised amount.

6.3  You should obtain independent professional advice or a formal valuation where required for lending, taxation, family law, deceased estates, insurance, litigation or another formal purpose.

7 Your responsibilities

7.1  You must be at least 18 years old and legally capable of using the Website and submitting an enquiry or request.

7.2  You must provide information that is accurate, current and not misleading, and promptly correct any material error you become aware of.

7.3  You must be the property owner, or have the owner’s authority, to submit a request containing information about a property or another person’s contact details.

7.4  You must use the Website lawfully. You must not submit fraudulent requests, impersonate another person, interfere with security or operation, introduce malicious code, scrape or harvest data without permission, or use Website information to send unsolicited communications.

8 Website and profile information

8.1  Although we may conduct reasonable checks or request corrections, we do not guarantee that every agent profile or other item of Website information is complete, current or error-free at all times.

8.2  Website content is general information only. It is not a substitute for advice tailored to your property, finances, legal position or objectives.

8.3  Descriptions such as local, member, professional, licence verified, Founding Member, Entry, Professional or Premier describe a location, check, network status or membership category. They do not guarantee a particular outcome.

9 Privacy and communications

9.1  We handle personal information in accordance with our Privacy Policy available at https://www.mysaleprice.com.au/privacy-policy/ and any collection notice shown when information is requested.

9.2  We may send communications reasonably necessary to administer an enquiry, referral, account or membership, respond to a request, maintain security or provide important service information.

9.3  We will send promotional electronic marketing only where consent or another lawful basis applies. Marketing messages will identify the sender and provide a practical way to unsubscribe where required by law.

10 Intellectual property

10.1  Unless otherwise stated, the Website and its text, graphics, logos, badges, layout, software and other content are owned by or licensed to My Sale Price and are protected by intellectual property laws.

10.2  We grant you a limited, revocable and non-exclusive right to access and use the Website for personal and lawful purposes. Except where the law permits, you must not copy, reproduce, adapt, publish, sell, commercially exploit or create derivative works from Website content without permission.

10.3  Member badges and recognition materials may be used only by authorised members and in accordance with any brand or membership conditions supplied by My Sale Price.

11 Third-party websites and services

11.1  The Website may link to third-party websites or services, including member agent websites. Those services are independently operated and may have their own terms and privacy practices.

11.2  A link does not necessarily indicate endorsement. Except to the extent required by law, My Sale Price is not responsible for third-party content, availability, security or services.

12 Website availability and changes

12.1  We aim to keep the Website available and accurate but do not guarantee uninterrupted, error-free or continuously secure operation. Maintenance, technical faults, cyber incidents or circumstances beyond reasonable control may affect access.

12.2  We may change, improve, suspend or discontinue Website functions where reasonably necessary. Where practicable, we will avoid materially affecting an appraisal request already being processed without notice.

13 Australian Consumer Law

13.1  Nothing in these Terms excludes, restricts or modifies a consumer guarantee, right, remedy or liability that cannot lawfully be excluded, restricted or modified, including under the Australian Consumer Law.

13.2  Any disclaimer or limitation in these Terms applies only to the maximum extent permitted by law and must be read subject to your non-excludable rights.

14 Responsibility and liability

14.1  To the extent permitted by law, My Sale Price is not responsible for the acts, omissions, advice, appraisals, statements, fees or services of an independent member agent, except to the extent a loss was caused or contributed to by our own breach, negligence or unlawful conduct.

14.2  We are not responsible for loss caused by inaccurate information supplied by a user or third party, a decision made under a separate agreement with an agent, unauthorised use contrary to these Terms or an event outside our reasonable control, except to the extent the law requires otherwise.

14.3  Where the law permits a remedy for failure to comply with a guarantee to be limited, our liability may be limited, at our option, to supplying the relevant service again or paying the reasonable cost of having it supplied again. This clause does not apply where that limitation would be unlawful or unfair.

14.4  You are responsible for reasonably foreseeable loss caused by your fraudulent, unlawful or deliberately harmful use of the Website, but not to the extent My Sale Price or another person contributed to that loss.

15 Restricting or ending access

15.1  We may restrict or end access where we reasonably believe this is necessary to address a serious or repeated breach of these Terms, fraud, security risk, unlawful conduct, misuse of personal information or a legal requirement.

15.2  Where reasonable, we will provide notice and an opportunity to address the issue before restricting access. Immediate action may be taken where delay could cause harm, compromise security or breach the law.

16 Complaints and dispute resolution

16.1  You may submit a complaint about the Website, Agent Directory or Agent Appraisal Referral Service using the contact details in section 20. Please describe the issue and provide information reasonably needed to investigate it.

16.2  We will aim to acknowledge a complaint within five business days and provide an outcome within 30 days where practicable. Complex matters may take longer, and we will keep you reasonably informed.

16.3  Nothing in this section prevents either party from seeking assistance from a regulator, tribunal or court where entitled to do so.

17 Changes to these Terms

17.1  We may amend these Terms to reflect changes to the Website, services, business practices or applicable law. The current version and effective date will be published on the Website.

17.2  Where a change materially affects an existing user or request, we will take reasonable steps to provide notice before the change applies, unless an earlier change is required for legal or urgent security reasons.

18 General

18.1  If a provision is invalid or unenforceable, it will be read down to the extent necessary or severed, and the remaining provisions will continue to apply.

18.2  A failure or delay in enforcing a provision does not waive the right to enforce it later.

18.3  These Terms are governed by the laws of Queensland, Australia. The parties submit to the courts and tribunals having jurisdiction in Queensland, subject to any right a person has to bring a claim elsewhere under applicable law.

19 Definitions

19.1  Agent or member agent means an independent real estate agent or agency participating in the My Sale Price network.

19.2  Agent Directory means the part of the Website through which users may search, browse and contact member agents.

19.3  Agent Appraisal Referral Service means the service through which My Sale Price reviews a homeowner’s request and refers it to one suitable participating member agent.

19.4  Appraisal means an agent’s estimate or opinion about a property’s potential sale price, rental value or management opportunity and is not necessarily a formal valuation.

19.5  Personal information has the meaning given by applicable Australian privacy law.

19.6  User, you or your means a person who accesses the Website or submits information through it.
